This matter was referred to me by the Regional Magistrate in terms of Section 116 (3)(a) of the
Criminal Procedure Act, 1977.[3] Accordingly, the Magistrate’s order separating the accused trials is set aside. The matter is referred back to the Magistrate’s Court, in order to ask accused 2 to plead to the charge. The Magistrate is further directed, before requesting accused 2 to plead to the charge, to fully explain to the accused the implications of the provisions of the Stock Theft Act, No 12 of 1990, as amended. Only in the event accused 2 has pleaded not guilty to the charge that there would be an order for separation of trials.
