[24 ] Before dealing with the irregularities in the procedure that was followed
two comments are apposite: Neither Motumi nor Luck qualified the
invitations that had been extended to the nominees for interviews; and'
according to the reasons furnished, the placement board initially decided
that interviews in respect of each candidate should be held. The procedure
described in the reasons does not comply with the requirements of the
formal annual placement process, as set out in the Interim Measures, in
various respects. The Interim Measures were prescribed by the Chief of
the SANDF. The main complaint is that the placement board, qua
administrator, failed to follow the prescribed (imperative: "must be
implemented" - Introduction par 1) procedure in the first portion of the
Interim Measures, which essentially requires that the formal procedure be
followed.
[25] S 3(1) of PAJA requires that administrative action, which materially
and adversely affects the rights or legitimate expectations of any person,
must be procedurally fair¹they are both on the same hierarchical level in the DOD

⁰. The first question that arises in this regard is:
which of Dunn's rights and/or legal expectations have been affected by the
respondents' conduct? It is common cause that Dunn applied for the post
and that the minister decided to appoint Coetzee in the post. Since the
respondents, for the purpose of selecting a suitable candidate, purportedly

invoked the formal placement process in the Interim Measures that decision in itself gave Dunn certain rights. Those rights were: The right to participate in the prescribed evaluation and selection process; the right ~ that the procedure followed must be properly applied; the right to uniform treatment throughout the selection and evaluation process; the right that fully motivated submissions containing "HR requirements and Succession Planning intentions of all Structure Managers" had to be submitted to and placed before the seminar for consideration; the right that a "prescribed Person Profile" of each of the nominees should serve before the seminar¹¹ and the right to be considered and evaluated for appointment by a formal
