POSTPONEMENT ORDER

1.       The Applicant is Ernst Frederick David Steynberg; an adult male residing in the Potchefstroom area. The Applicant represented himself at the hearing.

2.       The Respondent is HA Harper (sole proprietor) trading as Umdloti Construction from 50A Club Mykonos, Belamont Drive, Umdloti. The Respondent is not before the National Consumer Tribunal (the Tribunal). An email was received from the Respondent on the day of the hearing; that he was in hospital; but documentary proof of this was not available at the time of the hearing. The Respondent was accordingly not present at the hearing.

3.       The matter was set down on 8 August 2019.

4.       At the hearing, the Applicant requested a postponement in order to file an application in terms of Rule 15 of the Rules for Conduct of Matters Before the National Consumer Tribunal; seeking an amendment aimed at correcting aspects of the main application for leave to refer a matter directly to the Tribunal in terms of section 75(1)(b) of the Consumer Protection Act 68 of 2008.

5.       The main matter is unopposed.

6.       The postponement request was considered in the interest of allowing due process; which could result in additional information being available when the matter is fully heard.

ORDER

7.       The Tribunal made the following order:-

7.1The matter is postponed sine die.

7.2There is no order as to costs.
